The right of access to state-held information in a democracy cannot be overstated. It enables the governed to exercise control over the government. Many States have incorporated the right into their laws and others are in the process of doing so. Botswana has not taken any initiative towards enactment of such a law. This paper examines the extent to which this right is guaranteed under the Constitution of Botswana. It assesses how international jurisprudence has shaped the nature of the right and how a purposive interpretation of the Constitution, influenced by international jurisprudence, could give meaningful effect to the right.
